1. Acceptance of Terms
By accessing or using the services of Matchly Group LLC (“Company,” “we,” “us,” “our”), including our website, submitting applications, or communicating with us via SMS/text, you (“Candidate,” “you,” “your”) agree to be bound by these Terms and Conditions (“Terms”).
If you do not agree to these Terms, do not use our services.
2. Services Provided
We are a recruiting and staffing firm specializing in permanent and temporary placements.
Our services include but are not limited to:
Job matching and candidate placement
Resume review and career consultation
Interview coordination
Temporary staffing solutions
Ongoing candidate communication via phone, email, and SMS
3. Candidate Responsibilities
3.1 Accurate Information
You agree to provide accurate, current, and complete information in your applications, resume, and all communications. Misrepresentation may result in disqualification or termination of employment consideration.
3.2 Authorization
You authorize us to:
Share your profile and resume with prospective employers
Conduct background checks and employment verification (with your consent)
Contact your references
Verify your credentials and certifications
3.3 Job Search Conduct
You agree to:
Respond professionally to interview requests
Attend scheduled interviews
Notify us immediately if you accept employment elsewhere
Honor commitments made through our placement services
4. SMS/Text Messaging Terms (“Matchly Alerts Program”)
4.1 Program Description
The Matchly Alerts Program (“Program”) provides timely communications related to recruiting and job placement services. These messages may include job opportunities, application updates, interview reminders, onboarding information, and limited promotional content.
4.2 Consent to Receive Messages
By opting in to the Program, you consent to receive recurring automated and manual text messages from Matchly Group LLC at the mobile number you provide, including messages sent via an autodialer or pre-recorded voice.
Consent to receive texts is not a condition of receiving our recruiting services. Message frequency varies based on your engagement and activity.
4.3 Opt-Out Instructions
You may cancel the SMS service at any time. Simply text “STOP” to any message you receive. Upon sending “STOP,” we will confirm your unsubscribe status via SMS. Following confirmation, you will no longer receive text messages from us.
4.4 Rejoining the Program
If you wish to rejoin after opting out, you may sign up again through our website or consent form, and we will resume sending messages to you.
4.5 Help Instructions
If you experience issues with the Program, reply with the keyword “HELP” for assistance or contact us directly at bo@hirematchly.com.
4.6 Carrier and Rate Disclaimers
Carriers are not liable for delayed or undelivered messages.
Message and data rates may apply for messages sent to and from us. Message frequency may vary depending on your interactions with our services. For questions about your text or data plan, please contact your wireless provider.
4.7 Privacy
Your privacy is important to us. We handle all personal information in accordance with our Privacy Policy. Please review it for details on how we collect, use, and protect your data.
4.8 Compliance and Legal Notice
Our messaging practices comply with the Telephone Consumer Protection Act (TCPA), Cellular Telecommunications Industry Association (CTIA) guidelines, and other applicable federal and state regulations.
By participating, you acknowledge and agree that we adhere to these standards and reserve the right to update our SMS practices as required by law or industry policy.
5. Fees and Compensation
5.1 Candidate Fees
Our services are free to candidates. You will never be charged a fee for job placement services.
5.2 Temporary Placement Compensation
For temporary placements, compensation terms will be provided in a separate assignment agreement.
5.3 Client Fees
Client companies pay us fees for successful placements. This does not affect candidates.
6. Confidentiality
6.1 Company Confidentiality
You agree not to disclose confidential information about our clients, business practices, or proprietary methods.
6.2 Your Information
We will handle your personal information in accordance with our Privacy Policy.
7. Intellectual Property
All content on our website, including text, graphics, logos, and software, is owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws.
8. Limitation of Liability
8.1 No Guarantee of Placement
We do not guarantee job placement. Employment decisions are made solely by client companies.
8.2 Disclaimer
TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
8.3 Limitation of Damages
WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR SERVICES.
9. Indemnification
You agree to indemnify and hold harmless Matchly Group LLC, its affiliates, and employees from any claims, damages, or expenses arising from:
Your violation of these Terms
Your misrepresentation of qualifications
Your violation of any law or third-party rights
10. Background Checks and Compliance
10.1 Authorization
By using our services, you may be asked to authorize background checks, drug testing, and employment verification as required by client companies or law.
10.2 FCRA Compliance
All background checks will comply with the Fair Credit Reporting Act (FCRA). You will receive separate disclosure and authorization forms as required by law.
10.3 Equal Opportunity
We are an equal opportunity service provider and comply with all applicable employment laws.
11. Termination
We reserve the right to terminate or suspend your access to our services at any time, with or without cause, including for violation of these Terms.
12. Dispute Resolution
12.1 Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
12.2 Arbitration
Any disputes arising from these Terms or our services shall be resolved through binding arbitration in Florida, except where prohibited by law.
12.3 Class Action Waiver
You agree to resolve disputes on an individual basis and waive the right to participate in class actions.
13. Miscellaneous
13.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us.
13.2 Severability
If any provision is found unenforceable, the remaining provisions will remain in effect.
13.3 Waiver
Our failure to enforce any right does not waive that right.
13.4 Updates
We may update these Terms at any time. Continued use of our services constitutes acceptance of any updates.
